Corporate Insolvency

Tollers Insolvency team advises its clients on all matters arising out of or connected with business insolvency.

Prevailing economic conditions or seismic events, such as Brexit, poor management or failings in cash management and credit control can send a business to the very brink. If insolvency looms large we can offer advisory services to businesses who are looking to avoid a business insolvency event. If that proves to be impossible, our team of experts can guide a business through the insolvency process to its conclusion.

Tollers team of experts act for all stakeholders in the corporate insolvency process. Those stakeholders include Insolvency Practitioners, Lenders, Creditors and Suppliers to the business and of course both the Directors of the business and its investors.

Business Insolvency matters where we act will include the following:

  • We advise on the formal appointment process and thereafter on the disposal of the business or the purchase of it out of insolvency via a prepack or otherwise.
  • We are able to guide our clients through the different liquidation processes. Whether it is a compulsory insolvency via a liquidation brought about through creditor pressure and a winding up petition or a voluntary business insolvency achieved through the action of the company itself, our knowledgeable team can assist in the both the appointment and the process that follows. Likewise, where a company wishes to restructure, our team is on hand to assist in the solvent liquidation known as a Members Voluntary Liquidation.
  • Company Voluntary Arrangements. A voluntary arrangement is where a company at risk of corporate insolvency might engage with its creditors and seek to come to a contractual compromise with them.
