Can you claim compensation if you were not wearing a seat belt?
You can still make a claim even if you were not wearing a seat belt. If another driver was to blame for the collision then you can claim against them. The fact that you were not wearing a safety belt does not change that. This is called ‘primary liability’.
Unless you are exempt, the law says you should have been wearing a seat-belt. Failure to do so can sometimes be considered contributory negligent i.e. you having to accept some responsibility for your injuries (rather than the accident itself). This will reduce the amount of compensation you get. The deduction will not exceed 25% and in some cases there is no deduction at all. The law has been clear for many years:
- If medical evidence suggests that you would have escaped injury completely if you had been wearing a seat-belt then you lose 25% of the full value of your claim.
- If you would still have been injured not as severe, the deduction would be 15%.
- If failing to wear a seat-belt has made no difference to the injuries then you still receive 100% compensation.

Uninsured Driver RTA Compensation Claims
If you’ve been involved in a road accident with an uninsured driver, you can still make a compensation claim to the Motor Insurers’ Bureau (MIB). It’s a non-profit organisation funded by insurance companies that ensure innocent victims of accidents involving drivers without insurance still receive compensation.

Hit and Run RTA Compensation Claims
If you’ve been involved in a hit and run incident, you may be able to claim compensation through the MIB, even if you didn’t note the registration number of the offending vehicle. Provided you reported the incident to the police within 14 days if claiming for personal injuries, you can start the claims process.
